Moonpole Player Participation Agreement and Risk Notice
Moonpole Player Participation Agreement and Risk Notice
21 and Over Review Draft
This document has not been published or put into effect. All rules below are proposed and do not indicate that the product already has the relevant features or that compliance checks have been completed. The operator must first verify its actual practices, complete the placeholders, and obtain legal review for the applicable locations.
Operator: [Full legal entity name and registered address to be completed]Support email: [To be completed]Privacy contact email: [To be completed]Version and effective date: [To be completed after formal confirmation]
This agreement explains your eligibility to participate in Moonpole.games, the risks of AI content, and the scope of use of your information and photos. Please read it before registering, uploading information, or participating in the game.
1 Eligibility to participate
Participation in Moonpole.games is open only to people aged 21 or over. This is a participation requirement set by the platform, not a statement of the legal age of adulthood in any location. You must also meet the requirements of the laws applicable where you are located.
You must confirm your age and accept this agreement personally. You must not do so on behalf of anyone else or allow anyone under 21 to participate through account sharing or other means. Anyone under 21 may not participate, even with a parent’s or guardian’s consent.
2 Nature of the game and AI risks
Moonpole.games is an experimental AI game about lunar settlement. Based on the character information and photos you provide, the system may generate fictional content such as settler appearances, character actions, dialogue, comics, or videos.
AI-generated content may contain errors, bias, illogical or upsetting events, or may not meet your expectations. A character’s words and actions do not represent your actual conduct, views, experiences, or endorsement and should not be treated as a factual record of a real person.
Game content is not medical, legal, financial, or other professional advice. Game narratives, characters, or virtual outcomes do not represent real-world assets, investment interests, or promises of returns. We do not promise any particular storyline or generation result; this statement does not affect the service obligations we have under the law.
3 Uploaded information and limited licence
You may upload up to 5 photos as directed by the product. Please upload only information you have the right to use and photos that show only you and that you have the right to authorise for use. Do not upload other people’s likenesses, identity documents, intimate images, or protected content without permission.
You retain your existing rights in uploaded information. You grant the operator a non-exclusive licence, limited to what is necessary to provide the game features you request, to process the information, generate characters and related fictional content, and provide those results to you.
Service providers acting on our behalf may process this information only within a scope disclosed in advance and necessary to provide the relevant features. This licence does not transfer copyright in photos and does not authorise publication of original photos, advertising endorsements, sale of your likeness, or use of the information to train general-purpose models.
After you stop using the relevant features or withdraw from the game, new uses for generation will stop. Retention and deletion of existing information and results must follow the verified rules in the formal privacy notice and comply with applicable law.
4 Separate choices for public display and promotion
Participating in the game or uploading photos does not mean you consent to public display of your original photos or generated images that identify you.
If a feature requires images or content that identify you to be shown to other players or the public, we must separately explain the audience, content, and scope before enabling it and obtain your explicit choice. Use for promotion on the official website, social media, or in advertising also requires separate, optional authorisation and must not be bundled with consent to basic participation.
Any authorisation for public display or promotion must specify the materials, channels, duration, and withdrawal method. Declining promotional authorisation does not affect eligibility for basic participation. Arrangements following withdrawal should be explained in advance; we must not promise to retrieve every copy that third parties have already lawfully saved or shared.
5 Privacy and third party processing
Photos, character information, and generated content that identifies you may involve personal information. Before upload, we must provide a privacy notice consistent with our actual practices, stating at least:
• What information is collected and the purpose of each use;
• Which AI or hosting providers receive information and which countries or regions may be involved;
• Whether facial feature data is generated or retained and whether it is used for model training;
• Retention periods for original photos, generated results, logs, and backups;
• How to request access, correction, deletion, or withdrawal of relevant consent, and how to complain.
[The processing facts above and the privacy notice link remain to be verified. Uploads of real photos should not be enabled until these are completed.]
Merely showing you a privacy notice does not mean you have consented to every use described in it. Processing that requires separate consent must be separately agreed to.
6 Acceptable use and handling problems
You must not use the service to impersonate others, infringe privacy or intellectual property rights, harass anyone, or generate or distribute unlawful content.
If you find erroneous, infringing, or inappropriate generated content concerning you or someone else, you may request action through [Support email]. We may impose necessary and proportionate feature restrictions to investigate violations, security risks, or eligibility concerns. Where permitted by law and where doing so would not impede security measures, we will explain the reasons and provide a route to appeal.
7 Service risks and limits of liability
Experimental features may experience interruptions, delays, or generation failures. We will fulfil our obligations under the law and cannot avoid liability merely because a feature is “experimental”, content is “AI-generated”, or you accept this agreement.
This agreement does not exclude, limit, or modify any consumer protections, remedies, or liabilities that applicable law does not permit to be excluded, limited, or modified, including applicable rights under the Australian Consumer Law. Where the law requires a refund, re-supply of services, or another remedy, no platform policy may deprive you of those rights.
8 Withdrawal and changes to the agreement
You may stop participating and submit requests concerning your account and information through [Account settings path or contact email]. Withdrawal does not affect statutory rights that have already arisen.
Changes to terms concerning information use, public display, or other significant rights must be clearly notified before taking effect. Where the law requires renewed consent, it must be obtained again; silence or continued browsing must not be treated as a substitute.
Applicable law and dispute arrangements: [To be completed after verifying the operator’s location, service locations, and applicable law]. No arrangement may deprive users of mandatory protections or avenues for redress available to them under the law.
Interface checkbox wording
The following is proposed interface wording, not a signature or consent record. Use two required checkboxes that are unchecked by default. Do not combine all purposes into a single checkbox.
☐ I confirm that I am aged 21 or over and am participating only on my own behalf.
☐ I have read and agree to the Moonpole.games Player Participation Agreement and understand that AI content is fictional and may contain errors.
Provide a separate confirmation for photo uploads, after completing the actual privacy notice:
☐ I confirm that I have the right to use the photos I upload and that they show only me. I consent to their use to generate my game character and related content in accordance with the providers, processing scope, and retention rules explained before upload.
Optional public display and promotional authorisation
Obtain specific authorisations for public display and promotion separately, with no boxes checked by default. Example promotional checkbox:
☐ Optional: I agree to the use of the generated materials selected on this occasion for [Specific promotional channels] for [Duration]. I understand how to withdraw this authorisation. Declining does not affect basic participation.
The age checkbox is only a self-declaration and must not be described as “verified age”. This draft does not require identity documents to be collected by default. If stronger age assurance is needed, first assess applicable requirements and an approach that minimises data collection.
Items to confirm before launch
1. The legal operating entity, address, support and privacy email addresses, countries served, and applicable states or territories.
2. All actual AI and storage providers, cross-border processing, training settings, retention of logs and backups, and deletion capabilities.
3. Which in-game content is visible by default and whether it includes real names or identifiable generated images. If private mode is not supported, adjust the product or obtain separate, explicit consent for display.
4. Whether age declarations, consent version records, withdrawal, and complaint processes are genuinely available.
5. If paid features already exist, separately verify pricing, cancellation, and refund terms. This draft does not invent a payment mechanism.
Review by a lawyer familiar with the actual operating locations is recommended before this document is put into effect. This draft must not be treated as a guarantee that “all liability is waived”. Whether the Australian Privacy Act applies, and the specific obligations involved, still need to be verified in light of the operating entity.
Current implementation and pending items
Implementation information below was verified by the project manager on 23 October 2026; it is not an independent audit. It describes the current product, separately from the proposed agreement and consent wording above. The agreement has not been activated. Approval of the draft direction and bilingual documents does not mean the missing facts have been completed, legal review has been obtained, or activation has been authorised.
Photo handling: Up to 5 photos are converted to PNG and stored privately. The owner and supervising Admin can access them.
AI processing: The AI character interview sends the full character profile and recent dialogue to a shared AI service. Image generation is supervised by an Admin. The exact providers’ training, retention, and cross-border processing policies remain unknown.
Removing a reference: “Remove” only removes the current reference association. Stored images and copies in historical tasks may remain. Immediate deletion must not be promised.
Prepared character package: The current private package contains the character profile, background, and 3 generated images, but excludes reference photos. Preparing the package does not automatically enrol the player or publish it.
Player age gate: The 21-and-over player gate is NOT_IMPLEMENTED. Current age validation applies only to the fictional character’s age, not the player’s age.
Pending before activation: Verify provider policies and actual retention and deletion behaviour; complete the privacy disclosures, player age gate, and consent process. The proposed rules above do not establish that these capabilities already exist.
